Daniel DeWitt, the mentally ill man who bludgeoned Peter Cukor to death in his Berkeley Hills home in 2012, was sentenced Friday to 33 years to life at the Napa State Hospital.

Judge Paul Delucchi handed down the long sentence after listening to the impassioned testimony of Cukor’s widow, Andrea, his son Alexander, and his close friend Percival Banks. Delucchi described the case as one of the most tragic and serious he has ever seen in his court, the result of “a remarkable, almost unbelievable, sequence of events.”

“I won’t sit here and guarantee that this won’t happen again,” said Judge DeLucchi, looking at the Cukors and about 20 of their friends sitting in the courtroom. “I can guarantee Mr. Dewitt won’t do it again, but that comes at an incredible cost.”

Every year on the anniversary of her fiancé’s killing, Tiffieny Dean makes a pilgrimage to the Berkeley Police Department to remind investigators that, three years later, the case remains open.

“I make it a point to go down there,” she said. “I want them to know he did have people that loved him and cared about him. Every anniversary, I get up and I go down there so they won’t forget him.”

, “Toby” for short, was killed March 8, 2011. The 30-year-old Berkeley native was shot to death in his backyard in the 1600 block of Blake Street. Police have not yet arrested anyone in the case. Dean said the lack of closure has made it difficult to move forward.

At the time of his death, the couple had been together for 11 years. They have a son together, Julian, who’s now 10 years old and a fifth-grader at Cragmont Elementary School.

“Still, to this day, sometimes I think he’s going to walk through the door,” she said, of Eagle. “You wish or hope he would walk through the door. When they say time heals, I don’t think it does, because you’re stuck with the memories and know you’re never going to see or hear him again.” … Continue reading »

City officials on Tuesday released a transcript of Peter Cukor’s Feb. 18 non-emergency call to police, and in it he asks for police to come “right away” to deal with Daniel Jordan DeWitt, who allegedly killed him about 15 minutes later.

The two-page transcript, however, does not reveal what, if any, level of urgency Cukor conveyed in his voice.

Cukor and his wife Andrea first encountered DeWitt when they returned to their home on Park Gate in the Berkeley hills around 8:30 pm on Feb. 18. DeWitt was hanging around their driveway. Cukor asked DeWitt to leave and then called police at 8:45 pm on a non-emergency number to report that a stranger was lingering nearby:

“Cukor: “Yes, there is a gentleman, a young man hanging around my property. I think he is a transient. I’m not sure.
Dispatch: What is the address sir?
Cukor: 2 Park Gate Berkeley
Dispatch: And he is just standing around there?
Cukor: Yeah. He says that he lives here. He wants to come in which is very strange. I’d like an officer up here right away.” … Continue reading »

Councilmember Susan Wengraf (District 6) has called a town hall meeting to discuss public safety in the wake of the Feb. 18 murder of Peter Cukor outside his home in north Berkeley. Police Chief Michael Meehan and City Manager Christine Daniel will both be in attendance, as will a supervising dispatcher, and BPD Area Coordinator Officer Byron White.

In a communication to her constituents, Wengraf wrote that she was saddened and disturbed by the murder. “The circumstances surrounding the incident have raised many concerns about safety and police protection. I have talked to some of you personally and others by email. However, given the nature of the incident, I think that a public meeting where you all have an opportunity to voice your concerns and get answers to your questions directly from the Police Chief would be in the best interests of our community.” … Continue reading »

Berkeley hills neighbors react with shock to murder

Print Friendly

Update, 6:25 pm: BPD issued some new clarifications at 5:00 pm this evening about the February 18th killing. There follows a statement by Operations & Area 2 Commander Lt. Andrew Greenwood:

“BPD received a report of a suspicious person possibly trespassing. The caller calmly reported an encounter with a strange person on his property, and asked for an officer to respond. This call for service was queued for dispatch.

At that time, available Patrol teams were being reconfigured in order to monitor a protest which was to come into Berkeley from Oakland in the next hour. Only criminal, in-progress emergency calls were to be dispatched, due to the reduction in officers available to handle calls for service.

BPD subsequently received a call of an attack in progress on Park Gate Rd. Officers were immediately dispatched to that call. … Continue reading »

Kenny Warren had just left his job at the barbershop at 3019 Shattuck Ave. on Thursday evening and was walking around the corner to a friend’s house to watch a basketball game when he was pelted with a barrage of gunfire.

His assailants were lying in wait for the barber, port worker, and father of five, and fired off more than 80 rounds from a semi-automatic weapon and a pistol to make sure the 35-year-old was dead. After Warren collapsed on the porch of the duplex at 2114 Emerson St., the suspects walked up the stairs and fired some more rounds point blank into his body, according to witnesses.

“I heard him knock on the door and say ‘It’s Ken,’ said an occupant of the apartment where Warren was killed. She asked that her name not be used. “I went to answer the door, then hesitated. Then the bullets started flying and I heard him scream. There were so many bullets. They kept coming so fast. There were so many.” … Continue reading »

On a rainy Monday evening the family of Adolfo Ignacio Celedón Bravo, who was brutally gunned down just over a year ago on Sept. 12, 2010, gathered to plant flowering vines and lavender in his memory in a commemorative garden created by his fiancée near the spot where he fell on Adeline Street.

The murder of Fito, as he was known to his friends, has not been solved, and his family is hoping their presence here and the many meetings they have held with officials and the media will prompt someone in the community to come forward with information leading to the arrest of his killers.

The 35-year-old Fito and his fiancée Amber Nelson were walking home from a party in the early hours of the morning when they were ambushed and robbed by two assailants near Ashby BART. Fito was shot while trying to protect Nelson. The randomness of the killing shocked the Berkeley community.

Nelson said the hope was that somebody with information would show compassion and help track down the murderers. … Continue reading »
